TERMS AND CONDITIONS
Last updated: 8 October 2026
1. About us and these terms
These terms apply to your use of this website and to any scaffolding services we provide to you. The website and services are provided by JNB Scaffolding Ltd, trading as JNB Scaffolding, a company registered in England and Wales (company number 17359191). Our address is Unit 2 Frederick Road, Kidderminster, DY11 7RA. You can contact us at jnbscaffoldingltd@gmail.com or on 01562630026
By using our website, or by accepting a quote or asking us to start work, you agree to these terms. If you do not agree, please do not use our website or services. If we agree something different with you in writing, for example in your quote, that written agreement will apply instead of the part of these terms it changes.
In these terms, "we", "us" and "our" mean JNB Scaffolding, and "you" and "your" mean the person or business using our website or buying our services. If you are a "consumer", that means you are an individual using our services for purposes that are mostly outside your trade, business or profession, such as scaffolding for your own home. Your statutory rights as a consumer are not affected by these terms.
2. Our services
We provide domestic, commercial and industrial scaffolding, including erecting, altering, inspecting and dismantling scaffolding, in Kidderminster, Worcestershire and the surrounding areas.
The information on our website is a general guide to what we do. It is not an offer, and it does not form a contract.
3. Quotes and how a contract is formed
We usually arrange a site survey before giving you a quote, so that the price is accurate. Our quote sets out the work we will do, the price and the initial hire period.
Unless the quote says otherwise, a quote is valid for 30 days. A contract is formed when you accept our quote, whether in writing, by email, by message or by asking us to book a date. A quote is based on the information you gave us and what we saw at the survey. If the job turns out to be different, for example because access is more difficult than we were told, we will tell you before carrying on and agree any change to the price with you.
All prices are shown in pounds sterling. Prices include VAT where it applies and where we say so in the quote. If VAT is not included, we will add it at the rate in force at the time.
4. Our responsibilities
We will provide our services with reasonable care and skill, and we will erect, inspect and dismantle scaffolding in line with the law and recognised industry guidance, including the Work at Height Regulations 2005 and the TG20 guidance.
We will keep scaffolding that we erect in a safe condition and inspect it at the intervals the law requires while it is in place.
We will try to start and finish on the dates we agree, but dates are estimates unless we say otherwise. We are not responsible for delays caused by things outside our reasonable control, such as bad weather, unsafe conditions, late access, changes to the job or the actions of other contractors.
5. Your responsibilities
To help us do the job safely and on time, you agree to:
Give us accurate information about the property or site and the work being done, including anything that could affect the scaffold, such as weak ground, cellars, drains, underground services, overhead power lines, asbestos or fragile roofs.
Make sure we have safe and clear access to the site on the agreed dates, including space for delivery vehicles and, if needed, for our vehicles to park.
Get any permission needed for the scaffold to go where it is planned, for example from the landlord, freeholder, a neighbour or the local council. If the scaffold needs to go on a public pavement or road, a licence from the council will usually be needed. We can arrange this for you if you ask, and the licence fee and any extra charges will be added to your price.
Make sure the scaffold is not altered, moved, loaded beyond its stated capacity, or used for anything it was not designed for. Only we should add to, change or take down any part of it.
Make sure that anyone you allow to use the scaffold, such as builders, roofers or other tradespeople, uses it safely and follows our instructions.
Tell us straight away if you notice damage to the scaffold, or anything that looks loose or unsafe, and do not use that part of the scaffold until we have checked it.
Tell us when you no longer need the scaffold so that we can arrange to dismantle it.
If you do not meet these responsibilities and it affects our work, we may have to delay the job or charge you for any extra costs this causes us.
6. Ownership of the scaffolding
All scaffolding, boards, fittings and equipment we put on your site remain our property at all times. You must not sell, lend, move or take any of it, and you must not allow anyone else to do so. You must let us collect it when the job is finished or when the hire period ends.
7. Hire period and extra time
Your quote states the initial hire period. If you still need the scaffold after that period, the hire will continue, and we will charge for the extra time at the weekly rate stated in your quote. If your quote does not state a weekly rate, we will tell you the rate before the initial hire period ends.
Please let us know in good time if you think the job will run over, so we can plan the dismantle and keep your costs down.
8. Payment
Unless your quote says otherwise, we will invoice you after the scaffold is erected or at the stages stated in the quote, and invoices are payable within 14 days of the invoice date. For larger jobs, we may ask for a deposit or stage payments, which will be stated in the quote.
You can pay by the methods we tell you about when we invoice you, such as bank transfer.
If you are a business customer and you do not pay on time, we may charge statutory interest and reasonable debt recovery costs under the Late Payment of Commercial Debts (Interest) Act 1998. If you are a consumer and you do not pay on time, we may suspend any further work, and we may take steps to recover the money you owe us.
If you think an invoice is wrong, please tell us as soon as possible, and pay the part that is not in dispute.
9. Cancelling or changing your booking
Consumers. If you agree a contract with us away from our premises, for example at your home after a survey, or by phone, email or online, you have the right to cancel within 14 days of the day the contract is made, without giving a reason, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. To cancel, tell us clearly by email or in writing. If you ask us to start work within the 14 days, you must pay us for the services already provided up to the time you tell us you want to cancel. If you ask us to start work and the scaffold has been fully erected before you cancel, you will need to pay for the work done.
After the cancellation period, or if you are a business customer, you can still cancel or change your booking by telling us. If we have already ordered materials, booked labour, or done work for you, we may charge you for the reasonable costs we have incurred. If you cancel at very short notice, we may also charge for the time we have set aside for your job.
We may cancel or change a booking if we cannot carry out the work safely, for example because of unsafe ground, the weather or because the site is not ready. If we cancel for this reason, we will give you a full refund of any money you have paid for work we have not done, or we will agree a new date with you.
10. Weather and safety
Scaffolding can be dangerous to erect and dismantle in poor conditions. We may delay or stop work if we think it is not safe, including in high winds, ice, snow, heavy rain or poor light. We will let you know as soon as we can and agree a new date with you. We will not be responsible for any costs caused by a delay for safety reasons.
11. Damage to property
We take reasonable care to protect your property while we work, including using base plates and boards where needed. However, putting up scaffolding can sometimes leave marks on lawns, paving, driveways and soft ground, and may affect fragile surfaces such as old render, guttering or roof tiles. Please tell us about any existing damage, weak surfaces or items you want protected before we start. We are responsible for damage we cause by failing to take reasonable care, but not for marks or wear that cannot reasonably be avoided, or for damage that was already there.
12. Our liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that the law does not allow us to limit or exclude.
If you are a consumer, we are responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or of our failure to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable, and we are not responsible for any business losses, since our services are for domestic use.
If you are a business customer, we will not be responsible for any loss of profit, loss of business, loss of goodwill, or any indirect or consequential loss. Our total responsibility to you for any claim relating to a job will be limited to the price you paid, or should have paid, for that job. We are not responsible for damage caused by the acts of other contractors or third parties on the site, or by anyone who alters or misuses the scaffold.
We hold public liability insurance. If you need details of our cover, please ask us.
13. Problems and complaints
If you are unhappy with our services, please tell us as soon as possible by email or phone, and give us the chance to put things right. We will try to deal with your complaint promptly and fairly. If we cannot resolve it between us, you may have the right to use an independent dispute resolution service. As a consumer, you also keep all your legal rights, including the right to a repeat performance or a price reduction if our services are not carried out with reasonable care and skill.
14. Using our website
You may use our website for your own lawful, personal or business use to find out about our services and to contact us. You agree not to use it in any way that is unlawful, harmful or fraudulent, to try to gain unauthorised access to it or to our systems, to introduce viruses or other harmful material, or to copy or collect information from it automatically.
We try to keep the information on our website accurate and up to date, but we cannot promise that it is always complete, correct or current. We may change or remove content at any time. We are not responsible for any loss caused by relying on the general information on our site. Our website may link to other websites. We do not control them and are not responsible for their content.
We do not guarantee that the website will always be available or free of errors, and we may suspend or withdraw it at any time, for example for maintenance.
15. Intellectual property
We own, or have permission to use, everything on our website, including the text, logo, images, design and layout. You may view it and print a copy for your own use, but you must not copy, change, sell or publish it without our written permission.
If you send us photographs, plans or other material, you confirm that you have the right to do so. You agree that we may use it to carry out your job. We will only publish photographs of your property if you have agreed to this.
16. How we use your information
We use your personal information as set out in our Privacy Policy, and we use cookies as set out in our Cookie Policy. Please read both on our website.
17. Changes to these terms and to our services
We may update these terms from time to time. The version that applies to you is the one on our website on the day you accept our quote, unless we agree otherwise in writing. The date at the top of the page shows when they were last updated. We may also change or stop offering parts of our services, but we will honour any job you have already booked.
18. Other important terms
If we cannot do something we have agreed to because of events outside our reasonable control, such as severe weather, fire, flood, strikes, supply problems or government action, we will not be in breach of these terms, and we will contact you as soon as we can.
You may not transfer your rights or obligations under these terms to anyone else without our written permission. We may transfer ours to another business, and we will make sure your rights are not affected.
If a court decides that any part of these terms cannot be enforced, the rest will still apply. If we do not enforce any part of these terms straight away, that does not mean we have given up our right to do so later.
Only you and we have rights under these terms, and nobody else can enforce them.
19. Governing law
These terms, and any dispute or claim arising from them or from our services, are governed by the law of England and Wales. The courts of England and Wales will have exclusive jurisdiction, unless you are a consumer living in Scotland or Northern Ireland, in which case you may also bring a claim in your local courts.
